Back in January I had a fight with my girlfriend and we broke up. Hooked up with this other girl, lets call her A at a party my fraternity threw. We came back to her place and fucked. Her roommate/friend and her asking me if this will be a regular thing or just a one night stand and I remind them I'm leaving next week for study abroad.
The rest of that week A and I are hanging out, texting and meeting up and making out as she was on her period. I come to see her and we exchange goodbyes for the semester.
I come back now to my university and get called into the office. They told me that A filed a sexual assault charge on me but chose not to press charges. We both signed a no contact agreement and they let me know this wont affect my academics/scholarships in any way.
Now I'm pissed. Our encounter was clearly consensual but this bitch chose to cry sexual assault, even after she allowed me to visit her room multiple times after we fucked and we even went out with her friends to get food twice. I have messages from when this all took place and TWO of her roommates were there while we were fucking. One was fucking my homeboy and the other was just playing music trying to sleep.
How the hell do I "sexually assault" someone who told me to take her and her roommates back so we can fuck, we fucked, we went to walmart (because her hoe roommate needed plan B) and hung out multiple days after said "assault"?
If I had actually "assaulted" her, why wouldn't she press charges? I'm the president of my fraternity and the president of my scholarship's graduating class and this is slander against me.
I believe she cried assault because she saw that my girlfriend and I got back together as we were studying abroad and I guess she felt pumped and dumped or got jealous (since she asked the 'what are we' question). Maybe she's back with her boyfriend now and he found out so she claimed assault. Let it be known that at the party she stepped into another person's car and fucked him there too.
What do I do now? No defense is needed I was told as she's not pressing charges, but I've already heard rumors going around about me and people are probably thinking I raped the bitch or something.
Should I go back to the office and show them the text messages between us and show that clearly this was consensual or just move on with my life? Again, academically this won't affect me, but I'm more worried about my reputation especially as president of two organizations.

Haha. This is what happens after they get their dicks handed to them in court after their own kangaroo courts. They went from crucifixion to asking everyone to be nice.
Nothing. Stay away from her and if she approaches you get video of you trying to get away.
As in every case like this, I recommend talking to a lawyer even if it is just a short conversation. If you have financial issues, there are ways to help with that. Google is your friend and sometimes parents will have such a benefit with their employers.

Thanks. I'll reach out to some of my alumni who are in law practices and get their advice on this too.

My university offers full legal services from a dedicated law office to all students, look into that as well!
Throwaway10Seconds 6y ago
I'll check that out. Thanks for bringing it up

Was there an actual lawsuit that set a precedent? Was myself the target of one of these investigations that destroyed my social life on-campus.
Throwaway10Seconds 6y ago
I'll get more info on that. All I was told was that she requested a NCA, signed one, and wanted me to sign one too
thrway1312 6y ago
Having gone through the title II bullshit myself, do yourself a favor and thoroughly read the contract in its entirety; don't be afraid to contact a lawyer if anything seems questionable.
Throwaway10Seconds 6y ago
It was a short paragraph stating that we're not gonna contact each other. I'm typing up what happened and putting together my evidence then I'll hit up a lawyer later today
thrway1312 6y ago
Great idea, text logs are your friend.
TomFoo 6y ago
Not an attorney. Even if she doesn't press charges but does shitty things to you and your reputation, you may want to seriously consider filing a civil suit. What's the legal term, libel? Don't let the cunt get away with it.
Throwaway10Seconds 6y ago
That's what I was thinking about, but then what if she wants to press charges? Now I'm fighting this whole legal fight, gotta get a lawyer and get my parents involved
ElCthuluIncognito 6y ago
Careful with the Streisand effect
TomFoo 6y ago
That's just a natural legal counter, if I'm correct. You file civil suit, then she files counter civil along with pressing charges. It's gonna be messy, so crossing your fingers and hoping she doesn't do much damage to your rep while not making any move isn't a terrible idea either. Lot at risk here either way.
For everyone reading this: For protein's sake, look the fuck up if you live in a one or two party consent state in regards to wire tapping laws. If your state is one party, then record the audio on your phone every time you are alone with a woman. Even if you are in a two party state, try to get her permission to record. "It's my kink. I like to keep audio records of who I fuck. You mind?"

Attorney here. I would sue for defamation. She made serious allegations and if anyone in the future every so mentions assault on you, those are going to be seriously tough charges to beat. She already tried to F you over. You owe her nothing. Do what is best for you.
crixusin 6y ago
She'll lose, cause you have awesome evidence.
Sue this bitch for defamation and emotional damage. You need to get the report she filed against you so that you have her story. Then, when it changes, you'll have an even easier time winning.
Please update us. !remindme 10 days
Throwaway10Seconds 6y ago
I'll tell that to my lawyer and play it by his plan. Thank you
spcarlin 6y ago
don't let this slide, whatever you signed might be used as admission of guilt, this could come back to haunt you, deal with it now. Contact FIRE, they've done great work with these sorts of things, they provided lawyers and won cases against colleges who threw out men on sexual false assault charges
edit: a word
juliusstreicher 6y ago
Could you explain what FIRE is an acronym for? I know that the minute I google it, I will be besieged with sites from gay dogs to enema fetishists.
Thanks.
spcarlin 6y ago
I read your description, it's good enough for lawyers to start with, they can ask for additional details when they need to.
https://www.thefire.org Yeah google wasn't very helpful, had to do advanced search. Keep it up!
Throwaway10Seconds 6y ago
Thank you: I'll call them today.

I'm replying to you now, won't be long...

Now I realize that sighing might be an admission of guilt. I'll get legal help and call in a few hours as I go to work
anotherswingingdick 6y ago
The college asking you to sign a NCA is a constructive defamation.
It's easieer to sue the college than the girl.
The girl cannot pay damages. The college can. And probably will, to hush it up.
F_Dingo 6y ago
Get legal assistance and get even with her and the university. Let them know you'll play hardball and be a mean motherfucker.
Throwaway10Seconds 6y ago
Got it boss. Fuck her bullshit false accusations
oldredder 6y ago
Don't listen to that. Lawyer it: just go ask and pay what you must to get the answer
That video is KEY. It proves your innocence.
SHOW THEM THE VIDEO.
No. The lawyer can do that or no one at all.
You are delusional. They're planning right now to expel you.
DiggerClam wrote:
and he's 100% right. You never should have signed a damn thing.
Throwaway10Seconds 6y ago
I'll look into the lawyer. The NCA agreement doesn't say that I sexually assaulted her, just says that her and I will stay away from each other.
[deleted] 6y ago
They keep it in kangaroo courts because real courts require a burden of proof from the accuser. If you have the money you can sue her for defamation and then maybe sue the school as well, if this rumor is passed through the grapevine getting a job will be difficult... The mens rea for defamation is a falsity, made intentionally, that effects earnings.
You could be the hero that starts fighting back against the 41% of rape accusations that are fake a number that is no doubt growing.
Throwaway10Seconds 6y ago
I'll talk to a lawyer and based on what he suggests I should do, proceed accordingly.
DiggerClam 6y ago
Does signing that NCA mean that you're saying you sexually assaulted her but she can't press charges any more? Because that would be insanely stupid.
Throwaway10Seconds 6y ago
No it doesn't. She can still press charges in the future if she wants I was told
DiggerClam 6y ago
Holy fuck. Save EVERYTHING dude.
Throwaway10Seconds 6y ago
Done and backing it up and organizing it too
Tombo_Splice 6y ago
This problem is getting worse, I'm hearing it always more often that women are throwing around false sexual assaults/rape claims and getting the full support of the law. Could it be a result that women as a whole are getting more insecure as the years go on and they throw out these claims just to protect their own solipsistic and fragile insecurity?
_sell 6y ago
I've considered that video thing, or at least audio. I use my phone as a helmet cam when I'm on my motorcycle... guess I'll start using it when I'm on a girl. The app can record in the background, too. Brilliant.
